Abstract

The observance of procedural guarantees of the parties in any judicial process is essential to achieve the principle of a fair and due process. The line-up of guarantees has evolved both at the national and international level and it is especially relevant at the international level due to the fact that it depends on the conduct of the Countries, as well as on the internal configuration of the courts themselves. For this reason, the thesis is focused on the International Criminal Court: its regulation, the safeguard of the rights of the parties throughout the procedure and how the enforceability of its resolutions is guaranteed. It is noteworthy that, due to the nature of the crimes prosecuted, a higher standard of diligence is required or may be required by the courts. A regulatory, jurisprudential, doctrinal and historical analysis of specific rights and guarantees such as the accused right to remain silent or the degree and form of protection of victims in the process.
