- dc.description.abstract This paper analyses the decision of the Spanish Supreme Court of December 4th, 2013, which gives a qualitative step forward compared to the previous case law and considers a labor accident the en route accident suffered by a worker when he was traveling on a Sunday from his family residence to his labor residence, where he would stay overnight to return to his workplace the following day.
- dc.description.abstract Se analiza en el presente estudio la sentencia del Tribunal Supremo, Sala 4ª, de 26 de diciembre de 2013, la cual da un paso cualitativo respecto la anterior doctrina jurisprudencial, y considera accidente de trabajo “in itinere” el acaecido a un trabajador cuando se desplazaba un domingo entre la localidad del domicilio familiar a la localidad de la residencia laboral, donde pernoctaría, de forma previa, a su reincorporación el día siguiente al centro de trabajo.
