Digital art, NFTs and the protection of intellectual property rights

Abstract

The present project analyses crypto-art as a potential protection method for intellectual property rights of digital artists. In the last past years, the phenomenon of the blockchain has revolutionised the digital market. With the birth of this new technology, new opportunities have arisen to protect digital assets in a way we have never seen before. Although this technology has been popularly known for its financial use, digital artists have also discovered its benefits. With the use of Non Fungible Tokens, also known as NFTs, digital artists can insert their art pieces into a blockchain and experience the protection this method offers to the digital assets it contains. Nonetheless, this technology has also risks and disadvantages associated to its use. In this project I will study whether crypto-art can offer better protection of intellectual property rights than the traditional methods, such as the intellectual property register, the notarial deposit or the DRM. I will also analyse the main benefits and risks associated to the use of this technology and finally, I will study the potential reception of crypto-art in the Spanish and European legislation.Aquest projecte té per objectiu analitzar el cripto-art com un potencial mètode de protecció dels drets de propietat intel·lectual dels artistes digitals. Durant els últims anys, el fenomen del “blockchain” ha revolucionat el mercat digital. Amb el naixement d’aquesta nova tecnologia, han sorgit noves oportunitats per protegir els actius digitals com mai. Encara que aquesta tecnologia s’ha fet popular pel seu ús financer, els artistes digitals també han descobert els seus beneficis. Amb l’ajuda dels “Non Fungible Tokens”, també coneguts com a “NFTs”, els artistes digitals poden inserir les seves obres d’art a la “blockchain” per tal de gaudir de la protecció que aquest mètode ofereix als actius digitals que hi conté. Tanmateix, aquesta tecnologia té uns riscs i desavantatges associats al seu ús. En aquest projecte, faré un estudi sobre si el cripto-art pot oferir millor protecció que els mètodes tradicionals de protecció dels drets de propietat intel·lectual, com el registre de la propietat intel·lectual, el dipòsit notarial o el “DRM”. També analitzaré els principals beneficis i riscs associats a aquesta tecnologia i finalment, estudiaré la cabuda que hi pot tenir el cripto-art a la legislació europea i espanyola.
