Secret d'estat o accés a la informació pública?: Què preval?

Abstract

En l’ordenament jurídic espanyol, el principi general de publicitat dels actes públics es veu limitat per una llei preconstitucional de secrets oficials que restringeix indiscriminadament aquelles informacions que, sota la discrecionalitat de l’executiu, han estat considerades d’interès nacional amb l’objectiu de garantir la seguretat i la defensa del territori espanyol. A través de l’anàlisi de diverses lleis relatives a l’accés a la informació, així com de l’Avantprojecte de llei d’informació classificada, es pretén explicar la viabilitat de l’excepció al principi de publicitat tenint en compte els controls parlamentaris i judicials. A més, amb l’objectiu de comprendre el per què de l’existència de la informació classificada es fa una comparativa entre la perspectiva espanyola i l’americana.

In the Spanish legal system, the general principle of publicity of public acts is limited by a preconstitutional law of official secrets that restricts indiscriminately the information that, under the discretion of the executive, have been considered of national interest with the objective of guaranteeing the security and defense of the Spanish territory. Through the analysis of several laws related to the access to information, as well as the preliminary draft of the classified information law, we try to explain the viability of the exception to the principle of publicity, taking into account the parliamentary and judicial controls. Furthermore, in order to understand the reasons for the existence of classified information, a comparison is made between the Spanish and the American perspective.
