Abstract

This paper explores the historical and legal context, creation and contents of the Artificial Intelligence Act Proposal by the European Commission, the most relevant legal debates surrounding it, and particularly delves into how AI system requirements impact fundamental rights, as well as the way in which the rights of complaint and redress, information and public participation are materialized in the Proposal. The study unveils that while fundamental rights are theoretically recognized as inspiring principles of the Act, they are not translated into meaningful, concrete measures. This research contributes to the ongoing debates concerning the protection of fundamental rights in the European Proposal for an Artificial Intelligence regulation. It also submits that future studies compare the treatment of fundamental rights in the Proposal and in the final version of the Act, in order to analyse if the concerns raised have been addressed.
Aquest treball explora el context històric i jurídic, la creació i els continguts de la Proposta del Reglament d'Intel·ligència Artificial de la Comissió Europea, els debats legals més rellevants sobre la mateixa i, en particular, aprofundeix en com els requisits pels sistemes d’IA afecten els drets fonamentals, així com la manera com els drets de reclamació i reparació, informació i participació ciutadana es concreten en la Proposta. L'estudi revela que, si bé els drets fonamentals es reconeixen teòricament com a principis inspiradors de la normativa, no es tradueixen en mesures significatives i concretes. Aquesta investigació contribueix als debats actuals sobre la protecció dels drets fonamentals en la Proposta europea de regulació de la Intel·ligència Artificial. També suggereix que estudis futurs comparin el tractament dels drets fonamentals en la Proposta i en la versió final de la normativa, per tal d’analitzar si les problemàtiques que es plantegen han estat adreçades.
