- dc.description.abstract La implementación de medidas correctivas en la conducta de los niños resulta imprescindible para el cumplimiento del deber educativo que los padres tienen respecto a sus hijos. Sin embargo, al eliminarse en 2007 del Código Civil español la referencia al derecho de corrección, la aplicación de la causa de justificación por el ejercicio de este derecho en la jurisdicción penal (Artículo 20.7), ha quedado en entredicho. El desarrollo de una interpretación normativa armonizada de esta causa de justificación a nivel nacional, resulta indispensable para cumplir con las leyes internacionales, defender el interés superior del menor y respetar la integridad física y moral de los niños y niñas españoles.ca
- dc.description.abstract The implementation of corrective measures in children's behavior is essential for the fulfillment of the educational duty that parents have towards their children. However, with the removal of the “right of correction” from the Spanish Civil Code in 2007, the application of the ground of exemption from criminal liability for the exercise of this right (Article 20.7 of the Spanish Criminal Code) has been put into question. A harmonized normative interpretation must be developed at national level regarding this ground of exemption from criminal liability, in order to ensure the compliance with international law, with the defense of the best interest of the child and with the respect of his or her physical and moral integrity.en
