Abstract

This paper analyzes the decision of the Spanish Supreme Court of January 29, 2014. In this decision the court determines the judicial calcification of a collective dismissal due to alleged economic reasons agreed by a company member of a business group, dominated by individuals with family ties among them. The analysis of the alleged economic reasons is moved to second place, giving priority to the determination of the employer (formal employer versus business group) and to the attribution of liability to the individuals that adopted the decisions.
En el presente artículo se analiza la sentencia dictada en casación ordinaria por la Sala de lo Social del Tribunal Supremo en fecha 29 de enero de 2014. En esta sentencia se determina la calificación de un despido colectivo por pretendidas causas económicas, acordado por una empresa integrada en un grupo de sociedades, dominadas por personas físicas con lazos familiares entre ellos. El análisis de las pretendidas causas del despido objetivo pasa a un segundo plano, dándose prioridad a la determinación del sujeto patronal (empleadora formal versus grupo de empresas), y a la comunicación o no de responsabilidades a las personas físicas que adoptaban las decisiones.
