El presente trabajo tiene como objetivo principal realizar un análisis crítico de las principales causas de ineficiencia de la justicia civil italiana entre las que cabe destacar el sistema procesal actualmente vigente. Para comprender dicho sistema se examina el largo movimiento evolutivo que se ha desarrollado desde la aprobación del Codice di Procedura Civile hasta las más recientes reformas del proceso civil. Sin embargo, dada la imposibilidad de analizar las numerosas intervenciones legislativas, se limita el análisis a las que han tenido una incidencia más significativa en la configuración del sistema actual. Partiendo de tal análisis se elabora un diagnóstico sobre cuya base se pretende ofrecer, como conclusión al presente estudio, soluciones satisfactorias unitarias que de ser actuadas contribuirían a mejorar el funcionamiento de la justicia civil italiana, en el bien entendido de que el problema necesita una serie de intervenciones normativas que no pueden limitarse a la reforma del proceso civil, sino que deben extenderse a la restructuración de la administración de justicia.

The main objective of this study is to analyze the main causes of inefficiency of Italian civil justice among which has to be mentioned the procedural system currently in force. To understand the aforementioned system we will examine the long evolutionary movement that has developed since the approval of the Codice di Procedura Civile to the most recent reforms of civil procedure. However, due to the impossibility of analyzing the many legislative interventions, the analysis is limited to those that have had a more significant impact on the configuration of the current system. Starting from this analysis it is possible to make a diagnosis upon which it intends to offer, as a conclusion of this study, satisfactory solutions that, if actuated, would help to improve the functioning of the Italian civil justice, on the understanding that the problem needs a series of legislative interventions that cannot be reduced to the reform of the civil procedure but should be extended to the restructuring of the administration of justice.
