La prostitución como objeto de regulación por el derecho del trabajo

Abstract

En España la prostitución se desarrolla de manera encubierta mediante múltiples actividades, las cuales frecuentemente comportan el ofrecimiento de servicios sexuales. Este trabajo pretende abordar la viabilidad de una regulación, desde la perspectiva laboral, de dicha actividad. Para ello, este estudio se enfoca en examinar dos grandes áreas: en primer lugar, la protección jurídica de la prostitución, y, en segundo lugar, la respuesta del orden jurisdiccional social al desempeño de la actividad referenciada. Con este fin, se analizará la naturaleza y singularidades propias del ejercicio de la prostitución, así como la jurisprudencia y la doctrina judicial más relevantes que permitan comprender la posición actual de nuestros tribunales nacionales.

In Spain, prostitution is carried out covertly through multiple activities, which frequently involve the offering of sexual services. This paper aims to address the feasibility of regulating this activity from a labor perspective. To this end, this study focuses on examining two major areas: firstly, the legal protection of prostitution, and secondly, the response of the social jurisdictional order to the performance of this activity. To this end, the nature and singularities of the practice of prostitution will be analyzed, as well as the most relevant case law and judicial doctrine that allow us to understand the current position of our national courts.
