Towards Corporate Liability in Global Supply Chains: The ‘Own Activity’ Subcontracting Regime as a Source of Normative Inspiration

• dc.description.abstract The objective of this article is to contextualise the incipient European legislative process on corporate due diligence in global value chains, offering an overview of some of the main legislative initiatives in this field to date, as well as the pre-existing labour regulation on corporate vigilance over subcontracting chains in Spain. The article analyses how the liability regime of the lead or client company provided for in this regulation, which revolves around the concept of 'own activity', may constitute a useful precedent in the configuration of the criteria for attribution of liability for damages in global value chains, a question of particular importance, which will determine the real significance of the future EU directive.
• dc.description.abstract El objetivo de este artículo es el de contextualizar el incipiente proceso legislativo europeo sobre debida diligencia empresarial en las cadenas globales de valor, ofreciendo una visión general de algunas de las principales iniciativas legislativas al respecto hasta la fecha, así como de la preexistente regulación laboral en materia de vigilancia empresarial sobre las cadenas de subcontratación en España. El artículo analiza cómo el régimen de responsabilidad de la empresa principal o comitente previsto en esta última regulación, el cual gira en torno al concepto de ‘propia actividad’, puede constituir un precedente útil en la configuración de los criterios de atribución de la responsabilidad por daños en las cadenas globales de valor, una cuestión de especial trascendencia de cuya respuesta dependerá el alcance real de la futura directiva comunitaria.
