Abstract

This article concerns about the especially sensitive workers’ protection into the law. After studying how the courts apply the regulations (in a very similar way to the case of risk for motherhood on the workstation), it focuses on how the contradiction between a protection (that aims to keep the employee on his job) for especially sensitive workers and a precept from the Worker’s Statute, which allows the employer to dismiss a worker who becomes unfit for his job (among other reasons, because of a special sensibility), is solved.
Este texto versa sobre la insuficiencia de la protección que la normativa prevé para los trabajadores especialmente sensibles. Tras analizar los pasos que jurisprudencialmente se han establecido para la salvaguarda de su salud (los cuales son muy similares a los fijados para los casos de riesgo para la maternidad), se centra en cómo los tribunales resuelven el choque que se produce entre este régimen, encaminado a mantener al empleado en la empresa, y el precepto del Estatuto de los Trabajadores que permite la extinción del contrato por ineptitud sobrevenida (la cual puede estar determinad, precisamente por una especial sensibilidad).
