Abstract

El Tribunal de Justicia de la Unión Europea se pronuncia sobre la adecuación con el derecho a la libre prestación de servicios de la obligación de respetar el salario previsto en convenio colectivo impuesta a un subcontratista del licitador de un concurso público de tratamiento de datos municipales cuando aquél ejecutará la prestación de servicios desde un Estado miembro distinto de la administración licitadora. Resuelve el TJUE aplicando el principio de proporcionalidad: la referida obligación no está justificada ni desde la tutela de los trabajadores de la subcontratista, concluyendo, así, que imponer el pago de un salario superior que no guarda relación con el coste de la vida en el Estado miembro privaría a los subcontratistas establecidos en éste de obtener una ventaja competitiva de las diferencias existentes entre las cuantías de los salarios respectivos.
The European Court of Justice ruled on the adequacy with the right to freedom to provide services of the obligation to respect wages established in a collective agreement in the case of a subcontractor of the tender of a tendering process that develops the provision of services from a different Member State of the tendering administration.
