Catcalling: analysing the conflicts of its inclusion as a crime

Abstract

In this project we will analyse the conflicts of the inclusion of catcalling as a crime with a legal, criminological and gender perspective. In order to do so, we will present the theorical and legal framework in verbal street harassment, examine the theoretical and practical problems that the criminalization produce, and finally we will contextualise the (new) crime in the Spanish penal legislation. We aim to discuss the possibility of contradictions with the ius puniendi principles and whether or not is recommendable at a practical level for its implications. In the end, we arrive at the conclusion that it would be damaging to the principles of the law, specially to the principles of legal certainty, the ultimate ratio and proportionality, and harmful to the less privileged social stratums.

En aquest projecte analitzarem els conflictes de la inclusió de l’assetjament verbal al carrer com a delicte amb una perspectiva jurídica, criminològica i de gènere. Per a fer-ho, presentarem el marc teòric i jurídic, examinarem els problemes teòrics i pràctics que la criminalització genera i, per acabar, contextualitzarem el (nou) delicte en la legislació penal espanyola. El nostre objectiu és debatre els possibles conflictes amb els principis limitadors de l’ius puniendi i si és recomanable a nivell pràctic per a les seves implicacions una disposició tal. Finalment, arribarem a la conclusió que seria perjudicial per als principis legals, específicament pels principis de seguretat jurídica, última ràtio i proporcionalitat, i nociu per als estrats socials menys afavorits.
