Abstract

The purpose of this work is to study the informed consent from a legal and jurisprudential point of view, specifically, how demanding its provision is and what its infringement entails. For this, the content of the work is divided in two parts. In the first one, it is presented what informed consent is, its regulation and the close relationship it maintains with the right to healthcare information. This will lead to analyzing the degree of demand required by the jurisprudence for its correct obtaining, from two points of view, from the acts of curative medicine and the acts of satisfactory medicine. In the second, we analyze the criteria that the First Chamber and the Third Chamber of the Spanish Supreme Court adopt to identify the damage caused by the violation of informed consent, as well as the criteria for its quantification.
