Abstract

The claim for compensation is a key tool in any legal system. Due to their ubiquitous nature, the calculation of damages for the infringement of intellectual property rights exhibits significant peculiarities. In its essence, the formula underlying the dreifache Schadensberechnung is prevalent in Europe for a long time. However, the manner of applying it has constantly been discussed in practice. In 2004, the European legislator hat adopted the Directive 2004/48/EC on the enforcement of intellectual property rights. Its Article 13 provides requirements for determining the amount of damages. Even though a core objective was to ensure a high, equivalent and homogeneous level of IP protection in the Internal Market, there are still significant disparities in the Member States with respect to damage calculation. In a European law perspective, the thesis examines the extent to which the minimum harmonization foreseen in the Directive is adequate to achieve the objectives of IP Protection and the Internal Market. It in particular addresses the crucial question of how the harmonization approach affects free cross-border trade, the undistorted competition and the promotion of innovation today, considering the technical and economic changes in recent years and the further development of IP law at EU level.
La reclamación de indemnización es uno de los instrumentos fundamentales de cualquier ordenamiento jurídico. Debido a su carácter ubicuo, el cálculo de los daños por infracción de los derechos de propiedad intelectual muestra peculiaridades significativas. En su esencia, la fórmula subyacente a la dreifache Schadensberechnung prevalece en Europa desde hace mucho tiempo. Sin embargo, la forma de aplicarla se ha debatido constantemente en la práctica. En 2004, el legislador europeo adoptó la Directiva 2004/48/CE relativa al respeto de los derechos de propiedad intelectual. Su artículo 13 establece los criterios para determinar la cuantía de daños y perjuicios. A pesar de que uno de los objetivos principales era garantizar un nivel elevado, equivalente y homogéneo de protección de la propiedad intelectual en el mercado interior, siguen existiendo disparidades significativas en los Estados miembros en lo que respecta al cálculo de los daños. Desde una perspectiva de Derecho europeo, la tesis examina en qué medida la armonización mínima prevista en la Directiva es adecuada para alcanzar los objetivos de la protección de la PI y el mercado interior. En particular, aborda la cuestión crucial de cómo afecta el enfoque de armonización al libre comercio transfronterizo, a la competencia sin distorsiones y al fomento de la innovación en la actualidad, teniendo en cuenta los cambios técnicos y económicos de los últimos años y el desarrollo ulterior del Derecho de PI a escala de la UE.
