La difamación lingüística : delito, concepto y sistema

Abstract

En esta investigación haremos un análisis sistemático-conceptual del delito de difamación lingüística desde una perspectiva suprapositiva. Para ello, usaremos nociones propias de la teoría del lenguaje vinculadas a esta estructura lesiva, de la teoría general del delito, de la dogmática de los delitos contra el honor en algunos ordenamientos nacionales, y de la defamation propia de la tradición jurídica angloamericana. El análisis comprenderá el de las modalidades básica y agravada con publicidad de este delito, el de sus eximentes y el de sus circunstancias modificativas de pena. Al final de este estudio puramente conceptual, y aprovechando los conocimientos adquiridos en el mismo, analizaremos algunos de los problemas dogmáticos, más relevantes, de los delitos contra el honor en España.In this research we will make a systematic-conceptual analysis of the crime of linguistic defamation. To do this, we will use notions of the theory of language linked to this harmful structure, the general theory of crime, the dogmatics of crimes against honor in some national legal systems, and the defamation of the Anglo-American legal tradition. The analysis will include that of the basic modality and aggravated modality with publicity of this crime, that of its defenses and that of its modifiers of sanction. At the end of this purely conceptual study, and taking advantage of the acquired knowledge, we will analyze some of the most relevant dogmatic problems of crimes against honor in Spain.Programa de doctorat en Dret
