Guia de bones pràctiques en matèria d'acord extrajudicial de pagaments, concurs consecutiu i exoneració del passiu insatisfet: estudi, anàlisi jurisprudencial i la seva aplicabilitat

Abstract

Les dades mostren com, sobretot a partir de l’inici de la crisi econòmica i financera del 2008 i que actualment persisteix a Espanya, el concurs de creditors, i en particular, el de persones físiques va començar a tenir importància. El present treball es divideix en dues grans parts: per una banda, l’anàlisi de la “Guia de bones pràctiques en matèria d’acord extrajudicial de pagaments, concurs consecutiu i exoneració del passiu insatisfet” realitzada pel Grup de treball CEJFE sobre segona oportunitat des d’una perspectiva teòrica. Per altra banda, s’intenta veure a través d’anàlisi jurisprudencial l’aplicabilitat d’aquesta Guia i la transcendència que ha tingut en la matèria. La principal conclusió és que, tot i que les recomanacions, advertiments i bones pràctiques que s’exposen a la Guia són útils i faciliten el desenvolupament del procediment de Segona Oportunitat, no es pot establir una relació causa-efecte entre la seva publicació i un canvi de criteris en pronunciaments judicials, i això és perquè no és un document vinculant.

The data show how, especially since the beginning of the economic and financial crisis of 2008 and which currently persists in Spain, the bankruptcy of creditors, and in particular, the bankruptcy of individuals began to be important. This paper is divided into two main parts: on the one hand, the analysis of the “Guia de bones pràctiques en matèria d’acord extrajudicial de pagaments, concurs consecutiu i exoneració del passiu insatisfet” carried out by the CEJFE Working Group on Second Chances from a theoretical perspective. On the other hand, it is tried to see through jurisprudential analysis the applicability of this Guide and the importance that it has had in the matter. The main conclusion is that, although the recommendations, warnings and good practices set out in the Guide are useful and facilitate the development of the Second Chance procedure, a cause-and-effect relationship cannot be established between the publication of the Guide and a change of criteria in court rulings, and this is because it is not a binding document.
