La indemnización por causa de muerte en los accidentes de circulación : hacía una interpretación extensiva del baremo

Abstract

El baremo determina los familiares que tienen derecho a ser indemnizados por el fallecimiento de la víctima. Sin embargo, en determinados supuestos, las personas verdaderamente perjudicadas son otras distintas a las previstas por el legislador, las cuales quedarían privadas del derecho a ser indemnizadas por los daños sufridos. /nEl presente trabajo tiene por objeto el estudio de las diversas soluciones empleadas por la jurisprudencia para conceder el derecho a resarcimiento por la muerte de la víctima a determinados familiares a pesar de no constar como perjudicados en el baremo. Asimismo se analizará la solución otorgada en aquellos supuestos en que se producen perjuicios patrimoniales por daño emergente y lucro cesante no contemplados por la ley. Posteriormente, veremos cómo ha propuesto abordar legislativamente estos problemas la Comisión de Expertos para el estudio de la reforma del baremo. Finalmente, se examinarán los sistemas de valoración de daños empleados en distintos países europeos y en particular en Reino Unido, Alemania y Francia, con el fin de valorar la idoneidad de nuestro sistema y los elementos que se podrían tener en cuenta para mejorarlo.

Moreover we will analyze the solution given by the Courts in those cases where economic damages are caused by consequential damages and lost profits, when they are not contemplated by the law. Then, we will see how the Committee of Experts has proposed to redress these issues legislatively with the study of the reform of the scale. Finally, we will see the multiple compensation systems used in different European countries, we will analyze particularly the models used in the United Kingdom, Germany and France, in order to assess the suitability of our system and the elements that could be considered to improve it.
