La incapacidad temporal desde una perspectiva crítica: ¿Avance o retroceso en los procesos de despido, digitalización o género?

Abstract

La prestación por incapacidad temporal viene sufriendo, desde sus orígenes, constantes modificaciones y modulaciones tanto en su estructura, como en su funcionamiento y mecánica. Actualmente, la incapacidad temporal se erige en una de las prestaciones más problemáticas y caóticas de todo el sistema de Seguridad Social. Y es que, en torno a esta contingencia se circunscribe dos realidades enfrentadas, de un lado, la sostenibilidad económica de las arcas públicas y, de otro, el mantenimiento de los estados de necesidad ante la imposibilidad transitoria para prestar la actividad profesional habitual. Lamentablemente, la tendencia legislativa ha sido la de endurecer los procesos de incapacidad temporal, lo que ha convertido a ésta en una prestación desnaturalizada y que pone en serio riesgo de duda la misma noción de "trabajo decente" que ya se esboza a nivel internacional y comunitario. Pese a lo expuesto, durante los años 2022 y 2023 se han publicado varias reformas legislativas que han modificado cualitativamente esa tendencia restrictiva. Ciertamente, no se pretende ahora limitar tanto el derecho a la prestación temporal, sino más bien, ampliar el abanico de causas, al tiempo que se modernizan los engorrosos trámites burocráticos que ya venían sufriendo los trabajadores afectados y se le concede un perfil de género. En este trabajo se analizarán críticamente cada una de estas reformas, así como sus efectos prácticos.

Since its inception, the temporary disability benefit has undergone constant modifications and modulations both in its structure and in its operation and mechanics. Currently, temporary disability is one of the most problematic and chaotic benefits in the entire social security system. And it is that, around this contingency is circumscribed two realities faced, on the one hand, the economic sustainability of the public coffers and, on the other, the maintenance of states of need before the temporary impossibility to provide the usual professional activity. Unfortunately, the legislative trend has been to tighten up the processes of temporary incapacity, which has turned this into a distorted benefit and which seriously risks calling into question the very notion of "decent work" already outlined at international and community level. Despite the foregoing, a number of legislative reforms have been published during 2022 and 2023, which have qualitatively altered this restrictive trend. It is certainly not now intended to restrict the right to temporary benefit so much, but rather to broaden the range of causes, while modernizing the cumbersome bureaucratic procedures that the workers concerned were already suffering and giving them a gender profile. This paper will critically analyze each of these reforms, as well as their practical effects.
