• dc.description.abstract Abstract El presente artículo analiza la creación de la primera legislación que se elaboró a principios de s. XX en España para la regulación de los crecientes flujos migratorios hacia América y Francia. La misma se debe situar en el contexto de la reforma social que se inició entorno al Instituto de Reformas Sociales, y supuso la aplicación de los principios del “intervencionismo científico” en el ámbito migratorio. Sin embargo, la nueva norma no se sustrajo del la utilización de una lógica tutelar paternalista entorno al emigrante al cual se tildaba de “ignorante” y “limitada inteligencia”. This article aims to analyze the creation of first emigration laws in Spain at the beginning of the twenty century, the purpose of these norms was to regulate the growing migration influx to America and France. These laws must be placed in social reform context, a reform started by the “Instituto de Reformas Sociales” (Social Reforms Institute), applying to migration field the “Scientist Interventionism” principles. This new legislation didn’t avoid using a tutelary and paternalistic discourse on emigration, since emigrants were considered as “ignorant” and with a “limited mind”.
