Abstract

De todos los argumentos invocados para conseguir que el despido sin causa del trabajador enfermo sea declarado nulo, la STSJ de Cataluña de 14 de septiembre de 2021 aborda la posible vulneración que dichos despidos pueden suponer de la Directiva/78/CE, pero muy especialmente, la posible vulneración que dichos despidos pueden comportar del derecho constitucional a la integridad física previsto en el art. 15 CE.
