Abstract

The increase in the volume of space debris in Earth’s orbit poses a direct threat to the future use and exploration of Outer Space and a danger to the Earth’s own surface. Outer Space Law has failed to establish a legally binding regulation that addresses this issue effectively: neither the Guidelines for the Reduction of Space Debris are sufficiently complied with, nor have the protocols related to space debris issued by other actors. These circumstances have caused the record for space debris in Earth orbit to be broken again in 2020, forcing the enactment of legally binding international standards to respond to the many legal issues posed by this challenge, such as the tightening of restrictions that limit the creation of space debris and the extension of sanctions in case they are generated, bearing in mind the importance of space sustainability.
