Abstract

The emergence of digital platforms in the labour market has transformed the principles of labour law. Two main topics are covered in this study. Firstly, the recognition of the presumption of employment in contractual relations on digital platforms. This principle assumes that workers providing services for a digital platform are considered employees and therefore have basic employment rights recognised. And, it is explored how the new proposal for a European Directive aims to harmonise the presumption to include workers who are not protected by labour law and its effects under the Spanish regulation. Secondly, it is a question of how the regulation on the prevention of occupational risks and collective rights in the area of digital platforms should be brought into play. On the one hand, workers on digital platforms perform tasks that may involve health and safety risks, such as work stress and the need to be constantly connected to the mobile phone. However, it has also been discussed how to adapt the labour law to enable workers on digital platforms to organise themselves collectively, with special attention to the right to information and consultation.
