This idea parallels the idea that athletes ought to be role models in general. This paper first examines and critiques the “athlete as role model” argument and then applies this critique to the “athlete as political activist” argument. New iterations and new debates have arisen recently. Colin Kaepernick, backup quarterback for the San Francisco 49ers, found a powerful and controversial form of political action when he decided to sit for the playing of the national anthem prior to a preseason game on August 26, 2016. Kaepernick did this to draw greater attention to police violence against black and brown people in the United States. The story gained traction in the media, spurring on a renewed discussion about the intersection between athletics, Americanism, protest, and race. This paper will provide an overview of the Kaepernick protest, analyzing it through historical, sociological, and philosophical lenses. The specifics of the protest will be presented, including important interpretations of the protest, in order to show the debates that frame the prevailing ideas about how athletes like Kaepernick should behave. Following the introduction of relevant interpretations of the protest, historical ties will be made to earlier protests that will better situate Kaepernick’s protest. After the protest is historically situated, a number of philosophic principles that scholars should consider when thinking about Kaepernick’s protest will be introduced. Ultimately, the goal of this paper is to offer an informative foundation from which other scholarly interpretations and arguments can be made and which other scholars can reference.Metadata only Item type: Item , La contravención como amaño(Universitat Pompeu Fabra, 2017) Agüero, SebastianEn los últimos años, diversas organizaciones internacionales muestran consenso en la persecución de ciertas actividades reconocidas como perjudiciales para la integridad deportiva, v.gr., el amaño de partidos. Sin embargo, este consenso aún no se extiende a cuáles son los comportamientos que están incluidos en dicha categoría. Por ende, el presente trabajo tiene por objeto analizar el concepto de contravención, y a su vez, determinar qué conductas son subsumibles en una contravención, entendida como un tipo de amaño. Así, en primer lugar, analiza la sentencia del Tribunal de Arbitraje Deportivo (CAS 2014/A/3628), por constituir un hito en la materia; en segundo lugar, analiza los elementos que configuran la noción de contravención como un tipo de amaño a la luz de la tradicional noción de acción desarrollada por von Wright; y en tercer lugar, analiza y critica los argumentos esbozados en la sentencia para considerar las primas de terceros por ganar como un tipo de contravención. Por tanto, los tres niveles de análisis entregan herramientas teóricas y conceptuales destinadas a contribuir en la determinación de qué comportamientos son o no susceptibles de persecución por las organizaciones internacionales.Metadata only Item type: Item , Zola Budd and the Political Pawn(Universitat Pompeu Fabra, 2017) Sailors, Pam R.The attitude toward athletes engaging in political speech has varied over time, with activism often discouraged, but encouraged on rare occasions. The paper seeks to reconcile the two conflicting positions through proposing a more nuanced way to think about the relationship between athletes and political activism. Specifically, I argue that political speech, while obviously appropriate outside the field of play, has no place within the sporting arena. The paper begins with descriptions of the Colin Kaepernick case and the Zola Budd case. The main substance of the paper comes in laying out the position that athletes should not be activists, acknowledging a challenge to that position, and incorporating the notion of sacred space to establish the final conclusion.Metadata only Item type: Item , La vivencia personal de las lesiones deportivas: Un abordaje filosófico(Universitat Pompeu Fabra, 2017) Campos, DanielEste artículo investiga la experiencia personal del deportista cuando sufre una lesión que le impide continuar con la práctica de su deporte. La hipótesis propuesta es que cuando el deportista sufre una lesión así, vive un profundo proceso de cambio personal. Este cambio lo experimenta a niveles afectivos—sensaciones, emociones y sentimientos—, de actividades—por ejemplo, interrupción de la práctica, recuperación psicosomática, búsqueda de nuevas alternativas para la práctica deportiva —, y de sus fines y objetivos personales—la función y el propósito de las prácticas deportivas en su vida integral como ser orgánico-social. Se aborda la discusión desde una perspectiva personal. Esto quiere decir que se discute el proceso de cambio desde la perspectiva de la primera persona, de cómo lo vive “desde dentro” el deportista. El concepto de “persona” utilizado se basa en el pensamiento de Charles Peirce.Metadata only Item type: Item , The Revival of Athlete Activism(s): Divergent Black Politics in the 2016 Presidential Election Engagements of LeBron James and Colin Kaepernick(Universitat Pompeu Fabra, 2017) Marston, SteveIn the fall of 2016, LeBron James and Colin Kaepernick stood as two of the most visible figures in the recent revival of Black sport-activism. It is perhaps inevitable, then, that both men engaged in that season’s Presidential contest between Hillary Clinton and Donald Trump. However, they did so in disparate ways. James aligned himself with Clinton, publicly endorsing the Democratic candidate through an optimistic worldview in which benevolent social leadership paved the way toward lessened inequality, racial or otherwise. On the other hand, Kaepernick rejected both candidates as representatives of institutional oppression, instead favoring grassroots, community-based resistance. When placed in historical context, their actions reflect deep strands in the history of Black politics, particularly the distinct but overlapping ideologies of liberalism and radicalism. Through a study of their engagement with Presidential politics, it is demonstrated that contemporary sport activism, or what may be described as a network of interconnected “activisms,” echoes both the shared ideology and internal nuance present in Leftist Black politics for over a century.Metadata only Item type: Item , Kaepernick Flips the Script: Empowering the Silenced Black Athlete(Universitat Pompeu Fabra, 2017) Brackett, LaToyaColin Kaepernick, former quarterback for the San Francisco 49ers, committed no crime, but created an uproar within the United States of America after he took the conscious choice to sit (later kneel) during the National Anthem for the 2016 NFL season. He chose to sit in protest against the injustices faced by Blacks in America, especially after a tumultuous year of deaths of Blacks at the hands of the police. He sat in protest for the lack of justice for those killed. He sat because his conscious could no longer allow him to stand for the National Anthem that for him did not represent all Americans. He sat despite the financial success his career in football afforded him, and most likely he planned to maintain as his career. This paper explores the racial implications of Colin Kaepernick’s choice to protest the National Anthem, his stance of the issues that he protested, the various impacts on Americans, and the major impact on Kaepernick as a professional athlete in America. Utilizing two theories, the experiences of Kaepernick throughout his first year of protest, are analyzed. The goal of this paper is to give an accurate time line, with the emphasis on Colin Kaepernick as a representation of the Black male athlete in America. As the theories demonstrate, the Black athlete is not to be heard, and Kaepernick’s silent protest flipped the script on the silent Black athlete for the current generation, in the digital age. His courage to take a stand habitually, as a professional athlete, without a specific person in mind, but an entire cause, resonated with many—in positive and negative ways. A very prominent component to this impact resided in the racial implications, and they must be recognized.Metadata only Item type: Item , Programas de cumplimiento penal en clubes de fútbol(Universitat Pompeu Fabra, 2017) Solar, JesúsLa introducción en el año 2010 del régimen de responsabilidad penal de las personas jurídicas afectó por completo a los clubes de fútbol, quienes, desde ese mismo momento, y a consecuencia de la personalidad jurídica que la Ley les atribuye, pueden llegar a ser declarados penalmente responsables de ciertos delitos cometidos en su seno, entre los que destacan el dopaje, la corrupción deportiva entre particulares, el delito fiscal y el blanqueo de capitales, entre otros. No obstante, la posterior reforma operada en el Código penal en el año 2015 vino a establecer una vía de exención para aquellos clubes que, con anterioridad a la comisión del delito, se hubiesen dotado de programas de cumplimiento penal a fin de prevenir y detectar la comisión de delitos, así como reaccionar, en su caso, ante ellos, instaurando de este modo en el seno de la entidad una auténtica cultura de cumplimiento penal. En consecuencia, el presente trabajo tratará de individualizar y concretar, los distintos riesgos penales a los que se enfrentan los clubes de fútbol para, posteriormente, analizar las distintas singularidades y características que han de presentar los programas de cumplimiento penal de los mismos a fin de eximirles de responsabilidad penal en caso de comisión de actividades delictivas en su seno.Metadata only Item type: Item , Els valors a les escoles de futbol. Una proposta axiològica(Universitat Pompeu Fabra, 2017) Arranz Albó, XavierL’aparador social que suposa el futbol, ha permès la seva extensió, generant infinitat d’escoles, acadèmies, clubs i organismes amb la pretensió de formar joves futbolistes. És un objectiu primordial del nostre estudi constatar la necessitat de que aquestes institucions, haurien de tenir com a fita primordial garantir la formació del noi o la noia, no sols esportiva, sinó integral de la seva persona, inculcant-los tot un ventall de valors, exaltant els més sublims de la cultura. Pretenem afirmar en aquest treball, que aquestes institucions, haurien d’esdevenir en un fet axiològic, pel qual la finalitat última ha de consistir en la construcció i l’edificació de persones mitjançant la pràctica del futbol. Volem, incidir en aquells valors ètics que haurien de ser un marc de referència d’aquestes institucions, i a la vegada, fer una crítica que ha comportant aquesta dimensió planetària del futbol al nostre país sobretot arrel de les sancions que la FIFA ha imposat als clubs més importants per l’incompliment de certes normatives de contractació de menors d’edat.
