    ¿Cómo abordar la diversidad de género en la educación física escolar? Una propuesta para la práctica

    This essay discusses a practical problem faced by physical education teachers: how to incorporate a gender perspective and open to sexual diversity? There are some common practices that express a traditional and narrow model of physical activity that, among other questionable aspects, reinforces stereotyped gender roles. To overcome them, we argue that it is necessary to rethink and modify practices: to diversify physical activities to be carried out, to encourage cooperative rather than competitive logic and to organize flexible groupings according to purpose and interests, among other orientations, may contribute to produce new practices, more open and respectful of diversity.

    Domestic tax Regimes, foreign athle- tes and benefits of OCED Article 17 for sports contracts.

    In the UK the resident athlete is subject to British taxes on any income and capital gains on their worldwide earnings generated in the tax year, irrespective of where in the world the income or gains arose. The UK tax system is based on the principles of “residence” and “source” which means that if someone is a “resident” in the UK then they are subject to income tax rates in the country; however for non British residents the national taxation will apply if they have a “sour- ce” of income that is generated within the UK, and which does not draw the relief under the dou- ble tax treaty. This means for sportspeople who compete internationally even if they do not live in the UK their revenue will require tax planning and structuring, and the evaluation of the inco- me and outgoings from participation in events. There is much scope for creative structures after the implementation of the Organisation of Economic Cooperation and Development (OECD) Ar- ticle 17(2), that allows the Double Treaty Taxation in the field of sport. The argument that this is a provision that offers a fairer option for foreign athletes who are participating in sports events in the UK.

    Diez años de la Declaración de Ética en la Montaña (2009-2019): balance, desafíos y futuro

    The aim of this paper is to elucidate some of distinctive features of the 2009 Mountain Ethics Declaration and its current implications. Therefore, it is shown that mountain ethics is singled out by uniting mountain sport, nature and the physiology of the mountaineer. In the first part, the international mountain organizations (UIAA and Mountain Wilderness) are analyzed. The second part presents the proposal of Mountain Declarations (from Kathmandu to the 2009 Declaration), with a balance of the challenges. In the third part the alpine ethics is presented as a structuring of a new mountain ethics.

    Gender-related Media Coverage and the Olympic Games: An Integrated Literature Review

    The media coverage of female athletes and women’s sports at the Olympics has been pro- nounced since the 1990s. A number of studies have shown unique and varying findings and raised issues regarding the media coverage of female athletes and their sports at the Olympic Games. The purpose of this review is to identify key issues and discover trends in the litera- ture on media coverage of gender regarding the Olympics and Olympic athletes. The data collection method used here is centered on the collection of articles pertinent to the research topic using three electronic databases. The findings and discussions center on publication and methodological profiles, coverage differences, and emerging issues that include Olympics and nationalism, hegemonic masculinity in sports media, utilization of new media, and the cultural background of female athletes. Future research areas that highlight gender equality, unique Olympic settings, and perspectives on traditional versus new media are provided

    Feminism and finding meaning in group fitness

    Group fitness typically receives criticism from feminist scholars as a type of physical activity that reinforces negative cultural ideas about femininity and women’s bodies. While these criticisms are valid, they provide little framework for how participants may find meaning within the practice of group fitness. In this philosophic analysis, I outline the problems associated with group fitness, particularly those highlighted by feminist critics and provide ways that women who participate in group fitness can find meaning, especially by upending patriarchal and sexist notions about women’s bodies and femininity. To do this, I use the practice of Zumba fitness, a class choreographed to Latin-style dance music, as a way to illustrate the potential for meaning. My analysis draws from philosophic, sociological, and historical literature about fitness, group fitness, and femininity.

    Caster Semenya and the Cage Fight for Justice

    Given how contentious and divisive the case involving South African runner Caster Semenya and International Association of Athletics Federation (IAAF) eligibility policies is among sports fans, the media and academics, it is a good time for analysis of prominent arguments on both sides. We incorporate a discussion embedded in an account of a mixed martial arts (MMA) cage fight to address the ethical issues surrounding sex verification, the gender bina- ry in sport, testosterone and performance enhancement, and human rights. We consider this a unique way of examining arguments in support of Semenya’s eligibility to run in the women’s division and arguments against. While our treatment incorporates light-hearted ele- ments, we wish to emphasize that we do not mean to trivialize in any way the serious and im- portant issue under discussion and the harm that has already been done to persons as a result of IAAF policies.

    Tratamiento jurídico del deportista profesional extranjero

     In Spain, anyone who is not Spanish will be foreigner, but not every foreigner has the same legal treatment; the present article tries to expose these specificities and, therefore, to focus on the figure of the foreign professional athlete from that legal perspective, which concentrates these specificities in addition to other singularities exclusively related to athletes. Throughout the article, all of those singularities will be analyzed and it will conclude whether said singularities are beneficial or harmful for foreign athletes.

    Faltas estratégicas extremas en fútbol: análisis ético y reconsideración de sus sanciones.

    El presente artículo analiza desde el campo de la filosofía moral un tipo de acción que se produce en ocasiones especiales en partidos de fútbol. Se trata de lo que categorizamos como faltas estratégicas extremas, violaciones intencionadas de las reglas de juego que se llevan a cabo por parte del equipo defensor como medio para evitar una ocasión manifiesta de gol. Tras definir y caracterizar esta clase de acciones se procede a su análisis a la luz de las corrientes principales en ética del deporte (formalismo, convencionalismo e interpretativismo). Posteriormente se ponen de manifiesto los alicientes competitivos que explican su utilización, para, finalmente, proponer una alternativa a la forma actual de sancionar la comisión de las faltas estratégicas extremas que se entiende como más acorde con el espíritu del juego.

    Rethinking doping

    Despite the important role doping plays in the world of sport, insufficient attention has been given to understanding the concept of doping. In this paper, I argue that we should understand doping as a means of gaining a competitive advantage through the use of exogenous substances entering an athlete’s body, where such means undermine the relevant sporting institution. By focusing on sport as socially constructed institution, not merely as competition, we can have a unified explanation for many of our pretheoretic beliefs while giving the tools to understand doping in the ever-changing landscape of contemporary sport and society.

    Paying to Break the Rules: Compensation, Restitution and the Strategic Foul

    Some philosophers of sport have suggested that strategic fouling is acceptable if you pay full compensation. In this paper I will argue that the idea of ‘compensation’ is conceptually inadequate to deal with strategic fouling. Compensation is a legal remedy designed to make the victim of a wrong whole again, i.e. make good the loss or harm they have suffered. But compensation as the analogon between law and games is ill-conceived when applied to strategic fouling. I will suggest another analogon from the law of obligations – restitution – which is more apt to deal with strategic fouling and which shows more clearly why the ‘compensation’ prescribed by the rules often fails to restore the fouled side.

    Análisis, implantación e incidencia del compliance en el Derecho del Deporte.

    La progresiva y creciente corrupción, en el deporte en general es alarmante, conlleva a la necesidad de instaurar sistemas de cumplimiento normativo. El actual trabajo tiene como punto de partida, la observación y el estudio de la necesidad u obligación de la implementación del compliance, en la administración pública de la sociedad, y en las entidades deportivas. Se realiza un análisis sobre la cultura del cumplimiento, la influencia de la ética y la necesidad de establecer un proyecto de formación continua para una aplicación efectiva del compliance. Desde otra perspectiva, se tratará la justificación de la implantación de los modelos de cumplimiento de la legalidad en el sector deportivo, y los efectos y beneficios de dicha instauración. Desde la óptica de la transparencia y la buena gobernanza, se analizará la situación jurídica actual en el siglo XXI, y las irregularidades cometidas en los diferentes deportes, en el plano nacional e internacional. Se desarrolla a lo largo de la obra un estudio, análisis y observación sobre la ausencia de regulación legal obligatoria en la disciplina del compliance, y la falta del cumplimiento riguroso de la Ley 19/2013, Transparencia, acceso a la información y buen gobierno. Para finalizar, se examina la incidencia y repercusión del compliance en la sociedad deportiva, así como la responsabilidad de las organizaciones deportivas frente a la administración pública, y su proyección en cada entidad deportiva.

    Team Sports and Epistemic Trust

    This paper applies resources from social epistemology to the case of sporting activities involving teams.  Using Hardwig’s work on epistemic trust, I argue that organized team sport is an epistemic achievement where team members exhibit trust in each other’s abilities as skilled athletes.  Team sporting activity and success is shown to rely on participant’s knowledge of each other’s skilled abilities where this further requires moral trust in those abilities.

    Pragmatism, lex sportiva and the fair play principle in sports law

    Philosophers of sport have theorized on aspects of law that carry over into sport. These in- clude rule-making and interpersonal relationships in sports (Russel, 2011), the enforcement of regulations in sport, and the role that the Court for the Arbitration of Sport plays in determi- ning sport behavior. Throughout these discussions, we have learned that law intersects with sport in the court sector, in issues of human rights, privacy and athlete control (in the case of doping), and within-sport jurisdiction (and understanding the role of rules in sport-playing). One case that can contribute to studies of sport law is that of South African middle-distance runner Mokdadi Caster Semenya. Her public hearing against the IAAF has highlighted the ways in which regulating the female classification in sport overlaps with current understan- dings of the social and medical constructs around gender/sex, as well as the role that sport plays in determining social, medical and legal issues. As a welcome addition to this FairPlay special issue, this article interrogates the ways that lex sportiva (Posner, 1990) and the fair play principle (Vieweg, 2014) can decipher the conflating arguments surrounding Caster’s case. Pragmatism helps to clear away the superfluous information that makes this case so confusing. At the end I argue that Caster could use the argument of lex sportiva to bypass the Court for Arbitration of Sport and argue within the European Justice system on claims that her trial was systematically unfair.
