En el present treball s’analitza el paper de l’alcohol en els delictes de violació i agressió sexual amb accés carnal per via vaginal, anal o bucal. També amb introducció de membres corporals o objectes per alguna de les dues primeres vies. Es prendrà un període de 10 anys, des del 2012 fins al 2022. S’analitzaran totes les sentències que hi ha hagut compreses entre aquests anys a Espanya on l’alcohol hagi tingut un paper a tenir en compte.

També amb introducció de membres corporals o objectes per alguna de les dues primeres vies. Es prendrà un període de 10 anys, des del 2012 fins al 2022. S’analitzaran totes les sentències que hi ha hagut compreses entre aquests anys a Espanya on l’alcohol hagi tingut un paper a tenir en compte.
La finalitat d’aquest estudi empíric consisteix a intentar determinar quins factors tenen una incidència directa a la comissió d’aquests tipus de delicte en presència de l’alcohol, i l’afectació d’aquest tant a la defensa dels acusats als judicis com als resultats finals de les sentències. Per tant, intentarem demostrar si realment la presència d’alcohol als acusats d’agressió sexual o violació tenen un efecte atenuant o, fins i tot, eximent.

The purpose of this empirical study consists of trying to determinate which factors have a direct incidence in the comission of this kind of crimes in presence of alcohol, and his condition both in the defense in the trials and in the final results of the sentences. Therefore, we will try to prove if the presence of alcohol in the defendants of rape or sexual assault truly have a dimming impact, or even if an exemption effect.
