El derecho de transformación es una materia de gran relevancia para el estudio de la
Propiedad Intelectual en la actualidad. Se trata de un derecho con un amplio alcance y
complejidad, pues no en vano consiste en la facultad exclusiva del autor para autorizar
nuevas obras basadas en su propia creación. La materia, además del importante efecto
económico que conlleva dentro del sector de la producción cultural (traducciones,
adaptaciones, o arreglos musicales) presenta importantes preguntas para el Derecho de
Autor, que deberá responder a cuestiones sobre la autoría de la nueva obra, las
facultades del primer autor sobre la nueva obra, o los límites del derecho de
transformación. De igual forma, la irrupción de la tecnología digital ha conllevado la
aparición de nuevos supuestos de transformación (software, o sampling), por lo que se
hace necesario abordar su incidencia sobre la configuración del derecho tal y como se
ha entendido hasta el momento.

the digital technology has led to the emergence of new cases of transformation
(software or sampling), so it is necessary to address its impact on the configuration of
the right of transformation, as we understand it so far.
